The plain-English terms for using PivotScanner. By creating an account you agree to these terms.

The short version:PivotScanner is a subscription tool that helps you track vessel compliance — crew certificates, hours of rest, planned maintenance, and documents — including offline at sea. It is a tracking tool, not legal or compliance advice: you remain responsible for your vessels’ actual compliance. You own your data, you can cancel any time, and payments are handled by Creem as our merchant of record. Full details below.

1. Who we are

PivotScanner is operated by ML Upskill Agents UG (haftungsbeschränkt), a company registered in Germany, based in Vilseck, Bayern. In these terms, “we”, “us”, and “PivotScanner” refer to ML Upskill Agents UG; “you” refers to the vessel operator or company that holds the account. Our company details and Impressum are published at upskillagents.de.

2. The service

PivotScanner is an offline-first web application for small fleet operators. It helps you record and track crew certificates (STCW), hours-of-rest logs, planned maintenance, and vessel documents, and it surfaces what is missing or approaching expiry. Data you enter is stored securely and cached on your device so the app keeps working without a connection; changes sync when connectivity returns.

We may add, change, or remove features over time. Some features described in our marketing or help content may be delivered in stages; we aim to keep our public copy honest about what is available today.

3. Not legal or compliance advice

PivotScanner is a tracking tool, not legal or compliance advice — you remain responsible for verifying requirements with your flag State and DPA. It compares the documents and expiry dates you record against expected-document templates and surfaces what is missing or expiring. Those templates are sensible starting defaults, not a determination of what your vessels, crew, or trade actually require. A status of “Up to date” means the expected documents are on file and current in your account — it is not a certification that a seafarer may legally sail or that a vessel will pass a Port State Control inspection.

You must not rely on PivotScanner as the sole basis for a safety-critical or regulatory decision. Always confirm the actual requirements with your flag State administration, classification society, Designated Person Ashore (DPA), or a competent person.

4. Subscription, free trial & billing

PivotScanner is sold as a subscription, priced per vessel per month. The current rate is shown on our Pricing page and at sign-up.

Free trial.New accounts start with a 30-day free trial. No credit card is required to begin, and we do not charge you automatically — you only pay once you choose to add a payment method and subscribe.

Payments. Payments are processed by Creem as our merchant of record. Creem handles billing and applicable VAT/sales-tax compliance; your card details are processed by Creem and never touch our servers. Your subscription renews each billing period until you cancel.

Cancellation.You can cancel at any time from Settings → Billing. Your subscription runs to the end of the current paid period and does not renew; you keep access until then. You can add or remove a vessel yourself in the app; your per-vessel billing reflects the change from the next renewal, or contact us at support@pivotscanner.com to adjust it sooner.

Refunds

We do not offer pro-rata refunds for a partial period unless required by law.

5. Acceptable use

You agree not to:

  • use PivotScanner as the sole or final authority for a safety-critical or regulatory decision without independent verification (see section 3);
  • use the service unlawfully, or to store data you have no right to store;
  • attempt to breach the security or tenant isolation of the service, access another operator’s data, or probe, scan, or overload our systems;
  • resell, sublicense, or provide the service to third parties as your own, or reverse-engineer it except as permitted by law;
  • upload malware, or use the service to send unlawful, infringing, or abusive content.

We may suspend or terminate an account that materially breaches these terms, where practical after notice.

6. Your data & retention

The fleet, crew, and compliance data you enter is yours. Under GDPR we act as the processor and you are the controller. We do not sell your data or use it to train any AI model. How we handle personal data is described in our Privacy Policy.

You can generate compliance records (such as the Table B record of rest) as PDFs from within the app at any time. After you cancel, we retain your account data only as long as needed to let you reactivate or retrieve records and to meet our legal obligations, after which it is deleted. You may ask us to export or delete your data by contacting support@pivotscanner.com.

7. Availability

We work hard to keep PivotScanner available and to make the offline experience reliable, but we provide the service “as is” and do not guarantee uninterrupted or error-free operation. Because the app is offline-first, you can usually continue working locally during an outage, with changes syncing when connectivity returns.

8. Limitation of liability

To the fullest extent permitted by law, PivotScanner is not liable for indirect, incidental, or consequential losses, or for regulatory outcomes such as detentions, fines, or inspection findings — responsibility for your vessels’ compliance remains with you (see section 3). Nothing in these terms limits liability that cannot be limited under applicable law (including for death or personal injury caused by negligence, or for fraud). Subject to that, our total liability for any claim relating to the service is limited to the fees you paid us for the service in the 12 months before the claim arose.

9. Changes to these terms

We may update these terms as the product and our legal obligations change. If we make a material change, we will take reasonable steps to let you know. Continuing to use PivotScanner after an update means you accept the revised terms.

10. Governing law

These terms are governed by the laws of Germany, and the courts responsible for the seat of ML Upskill Agents UG (Bayern, Germany) have jurisdiction, to the extent permitted by applicable law. Mandatory consumer-protection rights in your country of residence are not affected.
